Terms of Service

Welcome to Piction! These Terms of Service ("Terms") govern your use of the Piction mobile application ("App") operated by OYE LLC ("we", "our", or "us"). By using Piction, you agree to these Terms.

1. Eligibility

  • You must be at least 13 years old to use Piction.
  • If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms.
  • We do not knowingly collect information from children under 13. If you believe a child under 13 is using the App, please contact us.

2. Account

2.1 Account Creation

  • You may play as a guest or sign in with Google or Apple.
  • Guest accounts have limited features and cannot sync across devices.
  • You are responsible for maintaining the security of your account.

2.2 Account Linking

  • You may link your guest account to Google or Apple to enable cloud sync.
  • Once linked, your game progress transfers to the linked account.

2.3 Account Termination

  • You may delete your account at any time through the App settings.
  • We may suspend or terminate accounts that violate these Terms.

3. Game Rules

3.1 How Piction Works

  • Each day, a new puzzle is available featuring an AI-generated image.
  • You have 6 attempts to guess the word depicted in the image.
  • Correct letters are revealed with color-coded feedback.
  • Scores are based on how quickly you solve the puzzle (fewer guesses = higher score).

3.2 Fair Play

You agree NOT to:

  • Use automated tools, bots, or scripts to play the game
  • Share answers publicly before the puzzle day ends
  • Create multiple accounts to manipulate leaderboards
  • Exploit bugs or vulnerabilities (please report them instead)
  • Reverse engineer or decompile the App

3.3 Leaderboards

  • Weekly and all-time leaderboards display top players.
  • Your display name and score are publicly visible on leaderboards.
  • We may remove users from leaderboards for violations.

4. In-App Purchases

4.1 Hints

  • Hints can be earned through gameplay or purchased.
  • Hints eliminate incorrect letter options to help solve puzzles.
  • Purchased hints are non-refundable except as required by law.

4.2 Rewarded Ads

  • You may watch optional video ads to earn free hints.
  • Ad availability may vary by region and time.

4.3 Payment Processing

  • All purchases are processed through Apple App Store or Google Play.
  • Prices are displayed in your local currency.
  • Refund requests must be made through the respective app store.

5. Intellectual Property

5.1 Our Content

  • Piction, including its design, code, images, and content, is owned by OYE LLC.
  • AI-generated images are created for each puzzle and are our property.
  • You may not copy, modify, or distribute our content without permission.

5.2 User Content

  • Your display name must not be offensive, impersonate others, or violate third-party rights.
  • We may change or remove inappropriate display names.

6. Privacy

Your use of Piction is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

7. Disclaimers

7.1 "As Is" Service

Piction is provided "as is" without warranties of any kind. We do not guarantee:

  • Uninterrupted or error-free service
  • That defects will be corrected
  • The accuracy of any content

7.2 Service Changes

  • We may modify, suspend, or discontinue features at any time.
  • Daily puzzles and content may change without notice.
  • We are not liable for any modifications to the service.

8. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, or consequential damages.
  • Our total liability is limited to the amount you paid us in the past 12 months.
  • Some jurisdictions do not allow these limitations, so they may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless OYE LLC from any claims arising from:

  • Your use of Piction
  • Your violation of these Terms
  • Your violation of any third-party rights

10. Dispute Resolution

10.1 Informal Resolution

Before filing a legal claim, please contact us to try to resolve the dispute informally.

10.2 Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

10.3 Arbitration

Any disputes will be resolved through binding arbitration rather than court, except for small claims court matters. You waive your right to participate in class actions.

11. Changes to Terms

  • We may update these Terms periodically.
  • Significant changes will be notified through the App.
  • Continued use after changes constitutes acceptance.

12. General

  • Entire Agreement: These Terms constitute the entire agreement between you and us.
  • Severability: If any provision is unenforceable, the rest remain in effect.
  • No Waiver: Our failure to enforce a right does not waive that right.
  • Assignment: You may not assign these Terms. We may assign them freely.
